These Terms and Conditions ("Terms") govern the use of this website and the supply of products and construction services by Kandh Projects ("Company", "we", "us", "our") to any person or entity ("Client", "you") who accesses the website, requests a quotation, places an order, or otherwise engages our products or services. By using this website or engaging our services, you agree to be bound by these Terms.
Kandh Projects trades in water infrastructure, utility, and industrial products, and undertakes construction and project execution services including pumping stations, borewells, transmission and distribution networks, solar installations, wastewater and utility network construction, and water storage tanks. The specific products, services, specifications, and scope of any engagement will be set out in the applicable quotation, purchase order, or contract agreed between the parties.
Quotations issued by Kandh Projects are valid for the period stated on the quotation and are subject to confirmation of stock, material availability, and site conditions at the time of order. An order is deemed accepted only upon written confirmation by Kandh Projects. Specifications, drawings, and technical data shared during the quotation process are indicative and subject to final confirmation in the order documentation.
Prices are as quoted at the time of order and are exclusive of applicable taxes, duties, and levies unless stated otherwise. Payment terms, including any advance payment, milestone payments, or credit terms, will be specified in the applicable quotation or contract. Kandh Projects reserves the right to revise pricing on undelivered orders in the event of significant changes in raw material costs, statutory levies, or currency fluctuation, subject to prior written notice to the Client.
Delivery timelines communicated by Kandh Projects are estimates and are subject to factors including site accessibility, statutory approvals, and force majeure events. Risk in goods passes to the Client upon delivery to the agreed site or dispatch point, as specified in the order. Title to goods passes to the Client upon receipt of full payment, notwithstanding earlier delivery.
Products supplied by Kandh Projects carry the manufacturer's standard warranty, where applicable, as communicated at the time of sale. Warranty coverage excludes damage arising from improper storage, incorrect installation, misuse, or normal wear and tear. Construction and installation services are carried out in accordance with the specifications agreed with the Client and applicable engineering standards; any defect liability period applicable to a specific project will be set out in the relevant contract.
Where Kandh Projects undertakes construction, installation, or commissioning works, the Client is responsible for providing accurate site information, timely statutory approvals and access, and any third-party clearances required for the works to proceed. Delays arising from the Client's failure to meet these obligations may affect project timelines and costs.
All content on this website, including text, graphics, logos, and design elements, is the property of Kandh Projects or its licensors and is protected under applicable intellectual property laws. Nothing in these Terms grants the Client any right to use Kandh Projects' trademarks, trade names, or proprietary materials without prior written consent.
To the extent permitted by applicable law, Kandh Projects' liability in connection with any product or service supplied shall not exceed the value of the relevant order or contract. Kandh Projects shall not be liable for indirect, incidental, or consequential losses, including loss of profit or business interruption, except where such exclusion is not permitted under applicable law.
Kandh Projects shall not be held liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including natural disasters, government action, statutory restrictions, strikes, or disruption to supply chains.
Any technical, commercial, or project-specific information shared between the parties in the course of an engagement shall be treated as confidential and used solely for the purpose of the relevant project, except where disclosure is required by law or with the prior written consent of the disclosing party.
These Terms are governed by the laws of India, including the Indian Contract Act, 1872 and the Sale of Goods Act, 1930, as applicable. Subject to Clause 13 below, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
The parties shall first attempt to resolve any dispute through good-faith negotiation. Where a dispute cannot be resolved amicably, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Chennai, Tamil Nadu.
Kandh Projects reserves the right to update or amend these Terms at any time. The version published on this website at the time of an engagement shall apply, unless expressly varied in writing in a specific contract or purchase order.
